These Terms of Service (“Terms”) govern your access to and use of forgeaccelerator.club and the Forge Accelerator services (the “Services”), operated by Emerio Group LLC (“Emerio,” “we,” “us”). By creating an account, purchasing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to purchase. The Services are not directed to children under 16, and we do not knowingly allow them to register. If you are between 16 and 18, you may use the Services only with the involvement and consent of a parent or guardian.

2. Accounts

- Provide accurate information and keep your account details up to date.

- Keep your password confidential; you are responsible for all activity under your account.

- Accounts are personal to one individual. You may not share, transfer, or sell access, or allow others to use your login.

- Access is delivered through a personal access credential (a unique link or key) tied to your identity and subscription tier. It is for your use alone. You may not share, forward, publish, or transfer it, and accessing the Services with one credential from multiple locations or accounts at the same time may be treated as prohibited sharing.

3. The Services

Forge Accelerator provides digital educational content, downloadable materials, a members’ community, subscription access, and optional AI-assisted tools. The Services are educational and informational only. They are not professional, financial, legal, medical, or psychological advice, and we do not guarantee any particular result or outcome.

4. Purchases, Pricing, and Billing

- Prices are shown at checkout and may change over time. You are responsible for any applicable taxes.

- Payments are processed by our payment provider, Stripe. By purchasing, you authorize the applicable charge.

- Subscriptions renew automatically at the then-current price until you cancel. You may cancel at any time; cancellation stops future renewals and takes effect at the end of your current paid period.

- Access is subscription-based and depends on an active, paid subscription. If your subscription ends — because you cancel (access continues to the end of your current paid period), because a renewal payment fails, or because a payment is refunded or reversed — your access to the paid Services ends and the associated access credential may be revoked automatically.

5. All Sales Final — No Refunds

All purchases are final and non-refundable, as described in our No-Refund Policy, which forms part of these Terms. Because digital content is made available to you immediately, you expressly request that we begin performance right away. Where you are a consumer in the EU, the UK, or another jurisdiction with a statutory withdrawal or cooling-off period for digital content, you acknowledge that by accessing the content immediately you lose that right of withdrawal once access begins. Nothing in these Terms removes rights that cannot be waived under the mandatory law of your country of residence.

6. Intellectual Property and Your License

All content in the Services — including text, workbooks, audio, video, frameworks, and the underlying work The Eternal War — is owned by Emerio or its licensors and is protected by intellectual-property law. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the content for your own personal, non-commercial learning. Your access credential (the link or key we issue you) is personal to you and non-transferable, and we may revoke it as described in Section 13.

You may not: copy, reproduce, redistribute, publish, sell, sublicense, or publicly post the content; share your access with others; use the content to build a competing product or service; or use the content (or your interactions with our tools) to train any machine-learning or AI system. These restrictions survive termination.

7. Acceptable Use and Community Conduct

- Do not share login credentials, scrape or bulk-download the Services, or attempt to circumvent access controls.

- Do not use the Services for any unlawful purpose or to infringe others’ rights.

- In the community, be respectful. No harassment, hate, threats, spam, solicitation, or illegal or infringing content. We may remove content and suspend accounts that breach these rules.

8. Your Content

You retain ownership of content you post in the community. You grant Emerio a worldwide, non-exclusive, royalty-free license to host, store, display, and reproduce that content solely to operate and provide the Services. You are responsible for what you post and confirm you have the right to post it.

9. AI Tools

Where offered, AI-assisted tools are provided as an optional convenience, on an “as is” basis. Their output may be inaccurate or incomplete and is not professional advice. Do not rely on it for important decisions. Our handling of data in these tools is described in the Privacy Policy.

10. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or that they will produce any specific result. Some jurisdictions do not allow the exclusion of certain warranties, so some exclusions may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, Emerio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the Services will not exceed the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including your non-waivable consumer rights.

12. Indemnification

You agree to indemnify and hold Emerio harmless from claims, losses, and expenses arising out of your misuse of the Services, your content, or your breach of these Terms, to the extent permitted by law.

13. Suspension and Termination

We may suspend, terminate, or revoke your access to the Services, in whole or in part, immediately and with or without prior notice, if: (a) you breach these Terms or misuse the Services, including by sharing, forwarding, or transferring your access credential or attempting to circumvent access controls; (b) a subscription payment fails or is not made; (c) you cancel your subscription (access then ends at the close of your current paid period); or (d) you obtain a refund or initiate a chargeback. Revocation may be enforced automatically and take effect on your next request to the Services. Access revoked for breach, or following a chargeback, does not entitle you to any refund. You may stop using the Services at any time and cancel any subscription. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and any fees owed) will survive. To enforce a revocation and prevent renewed unauthorized access, we may retain limited identifying information as described in our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules, and the exclusive venue for any dispute will be the state or federal courts located in Harris County, Texas, to the extent permitted by law. If you are a consumer, you also keep the protections of the mandatory laws of your country of residence, and this clause does not deprive you of them.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new effective date and, where appropriate, notified to you. Continued use after changes take effect means you accept the updated Terms.
